Release and Consent Agreement

This Release and Consent Agreement (the “Agreement”) is entered into by and between GolfInRed LLC, a company organized and existing under the laws of California (referred to herein as “GolfInRed” or “Company”), and the participant registering for GolfInRed events (referred to herein as the “Participant” or “Player”).

By signing or checking the box to indicate acceptance of this Agreement, the Participant agrees to be bound by the terms and conditions set forth herein.

1. Assumption of Risks: The Participant acknowledges and understands that participation in golf tournaments and related activities involve inherent risks, including but not limited to physical exertion, injuries, and property damage. The Participant voluntarily assumes all risks associated with participating in GolfInRed events.
2. Release of Liability: In consideration of being permitted to participate in GolfInRed events, the Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby fully and forever releases and discharges GolfInRed, its directors, officers, employees, agents, and representatives from any and all liabilities, claims, demands, actions, causes of action, costs, and expenses, whether at law or in equity, arising out of or in connection with the Participant’s participation in GolfInRed events, including but not limited to personal injury, property damage, or any other loss, whether caused by the negligence of GolfInRed or otherwise. The Participant further agrees to indemnify and hold GolfInRed harmless from any claims, damages, or liabilities arising out of their participation in the event.
3. Use of Content: The Participant grants GolfInRed and its authorized representatives the irrevocable right and permission to use, reproduce, distribute, publish, display, and modify any photographs, videos, audio recordings, or interviews taken during GolfInRed events (collectively, “Content”), for marketing, promotional, educational, or any other lawful purposes without compensation or notification to the Participant. The Participant waives any rights, claims, or interest, including but not limited to copyright or moral rights, in or to the Content.
4. Confidentiality: The Participant agrees to maintain the confidentiality of any confidential information disclosed by GolfInRed during the course of participation in GolfInRed events. Confidential information includes, but is not limited to, trade secrets, proprietary information, financial information, and any non-public information concerning the business operations, strategies, or activities of GolfInRed.
5. Medical Release: In the event that the Participant requires medical attention during the event, the Participant consents to receive necessary medical treatment. The Participant further acknowledges that GolfInRed is not responsible for any medical costs incurred and that they are solely responsible for their own medical insurance coverage.
6. Age Verification: The Participant verifies that they meet the minimum age requirement for participation in GolfInRed events, and they acknowledge that they may be required to provide proof of age if requested by GolfInRed.
7. Rules and Regulations: The Participant agrees to abide by all rules and regulations set forth by GolfInRed during the event. Failure to comply with these rules and regulations may result in the Participant’s disqualification or removal from the event.
8. Event Cancellation or Changes: GolfInRed reserves the right to cancel, reschedule, or make changes to the event format in its sole discretion. In the event of cancellation or changes, GolfInRed will make reasonable efforts to notify Participants in a timely manner. GolfInRed shall not be liable for any costs, expenses, or damages incurred by Participants as a result of event cancellation or changes.
9. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of California Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California.
10. Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
